7/19/2022 Village Board Meeting

Ordinance regarding 15-minute parking and the sale of cats, dogs, and rabbits, strategic plan implementation progress, parking and safety concerns downtown, water system master plan, rescheduling August 2, 2022 meeting, equipment and capital improvement plan, committee appointments, license approvals, monthly check approvals. Closed Session regarding Riverside Preserve Developers Agreement and 460 Park Ave and Wisconsin Department of Natural Resources.

VILLAGE BOARD REGULAR MEETING MINUTES
July 19, 2022

1. Call to Order and Roll Call

President Knutson called the meeting to order at approximately 7:03 p.m.

Village Board members present: Trustee Ed Hill, Trustee Bob Rohde, Trustee Kelli Belt, Trustee Chris Krasovich, Trustee Craig Roberts, Trustee Jim Grabowski, and President Jeff Knutson.

Also Present: Village Attorney, Mark Blum; Administrator, Scott Gosse; Director of Public Works, Dan Naze; Deputy Chief, Mark Garry; and Village Clerk, Cassie Smith.

3. Approval of Minutes of Previous Meeting

a. Minutes of the Regular Village Board Meeting – July 5, 2022
Trustee Grabowski motioned, seconded by Trustee Hill to approve the July 5, 2022 minutes of the Regular Village Board meeting as presented with the following changes:

4. Citizen Comments -

Cathy Cunningham @ 223 Lake Street - Ms. Cunningham spoke in support of Ordinance 2022-10 regarding prohibiting the sale of cats, dogs, and rabbits.

Prince Boparci @ 161 W Wisconsin Ave- Mr. Boparci opposes removing parking in the downtown area.  He believes the parking would be better suited on the opposite side of the street. 

Steve Rucci @ 161 W Wisconsin Ave- Mr. Rucci offered suggestions that should be tried before making a decision on the downtown area.  

Mark Grabowski @ 244 Park Ave- Mr. Grabowski thanked the Friends of Park and Recreation, and the Rohde's for their hard work and he thanked the individuals who purchased ducks during the Fourth of July festivities.  He spoke in support of Ordinance 2022-10 regarding prohibiting the sale of cats, dogs, and rabbits.

Charlie Shong @ 216 Highland Ave - Mr. Shong supports Ordinance 2022-10 regarding prohibiting the sale of cats, dogs, and rabbits.  Regarding downtown parking, he offered ideas to help the area.  He also spoke in regards to the strategic plan and offered a suggestion to bring in all businesses to form a plan.

Emily Grabowski @ 244 Park Ave -Ms. Grabowski spoke in support of Ordinance 2022-10 regarding prohibiting the sale of cats, dogs, and rabbits.

Cade Gerlach @ 1034 Oak Cir - Mr. Gerlach spoke in support of removing downtown parking.

Beth Furmo @ 838 Ringtail Court - Ms. Furmo spoke in support of Ordinance 2022-10 regarding prohibiting the sale of cats, dogs, and rabbits.

Zack Stephens @ 161 W Wisconsin Ave - Mr. Stephens offered ideas regarding downtown parking and stated the Village Board should wait to see the outcome of the speed humps before making a decision. 

Sarah Stephens @ 161 W Wisconsin Ave - Ms. Stehens stated that 2 parking stalls dedicated to Beach Bum would not be enough parking for their business downtown and suggested the Village gather more statistical evidence before making any changes.

Nicholas Jenick @ 333 Park Hill Drive - Mr. Jenick suggested having all options be evaluated and he stated he is not in favor of removing the parking.

Julie Gilmore @ 11706 W Deerbourn, Wauwatosa - Ms. Gilmore spoke in support of Ordinance 2022-10 regarding prohibiting the sale of cats, dogs, and rabbits.

Shannon Spaderlock @ W244N4429 Swan Rd - Ms. Spaderlock spoke in opposition to taking away the downtown parking.  She spoke in support of Ordinance 2022-10 regarding prohibiting the sale of cats, dogs, and rabbits.

Christin Schubert @ 10431 Wisconsin, Wauwatosa - Ms. Schubert spoke in support of Ordinance 2022-10 regarding prohibiting the sale of cats, dogs, and rabbits.

Megan Nicholson @ 806 W Shore Drive - Ms. Nicholson spoke in support of Ordinance 2022-10 regarding prohibiting the sale of cats, dogs, and rabbits.

Molly Weinfurter @ 1105 S 117th St, West Allis - Ms. Weinfurter spoke in support of Ordinance 2022-10 regarding prohibiting the sale of cats, dogs, and rabbits.

Susie Rodriguez @ 115 W Wisconsin Ave - Ms. Rodriguez spoke in support of Ordinance 2022-10 regarding prohibiting the sale of cats, dogs, and rabbits.

Anna Peterson @ N25W26481 Whitetail Ct - Ms. Peterson spoke in support of Ordinance 2022-10 regarding prohibiting the sale of cats, dogs, and rabbits.

Samantha Craig @ 344 Park Ave - Ms. Craig spoke in support of Ordinance 2022-10 regarding prohibiting the sale of cats, dogs, and rabbits.  She stated that the Village Board has a good start on the downtown with installing speed humps.

Jim Perry @ W378 S5059 W Pretty Lake Rd - Mr. Perry spoke in support of Ordinance 2022-10 regarding prohibiting the sale of cats, dogs, and rabbits.  He suggested that the downtown parking could be a multi-level parking lot.

Theresa Hoff @ 1276 Timber Ridge - Ms. Hoff made suggestions regarding enforcement in the downtown area.

Sandy Mancoda @ W276N2177 Spring Creek Drive - Ms. Mancotta spoke in support of Ordinance 2022-10 regarding prohibiting the sale of cats, dogs, and rabbits.

Tom Schreibel- Representative for Pet Land - Mr. Schreibel spoke in opposition of Ordinance 2022-10 regarding prohibiting the sale of cats, dogs, and rabbits and gave a breakdown of credentials Pet Land requires from each breeder.

Rachel Goedheer @ 309 Park Ave - Ms. Goedheer spoke in support of Ordinance 2022-10 regarding prohibiting the sale of cats, dogs, and rabbits.

Monica Kaskey W220N7841 Golf View Ln - Ms. Kaskey spoke in support of Ordinance 2022-10 regarding prohibiting the sale of cats, dogs, and rabbits.

5. Ordinances - 

a. Possible Action on Ordinance No. 2022-09, Ordinance to Amend Section 86.119.5(c) of the Municipal Code of the Village of Pewaukee
Trustee Rohde suggested that this ordinance may be premature based on not having a clear vision of what the changes will be in the future.  Trustee Grabowski stated that this ordinance was discussed at the Public Works and Safety Commission.  Discussion followed regarding the implications of approving this ordinance regarding designating two 15 minutes parking stalls which will give some relief to Beach Bum Bakery.
Trustee Hill motioned, seconded by Trustee Grabowski to Approve Ordinance No. 2022-09, Ordinance to Amend Section 86.119.5(c) of the Municipal Code of the Village of Pewaukee as Presented.
Motion carried 7-0.

b. Possible Action on Ordinance Prohibiting Sale of Cats, Dogs and Rabbits
Attorney Blum explained that the ordinance presented at the July 5th, 2022 meeting was revised to speak to the concerns at the last meeting.  Trustee Roberts stated that he believes that this ordinance doesn't give enough details regarding retailers and addressing breeders.  He suggested looking into the zoning ordinances as the zoning speaks to what is allowed or not allowed.  Trustee Grabowski disagreed and believed the ordinance is clear.  Trustee Krasovich supports the ordinance. Trustee Rohde stated that he believes this is a state or federal issue.  Trustee Belt also stated that she believes the consumers have to do their research and that punishing all for the acts of a few is not the right approach.  Trustee Hill stated he doesn't like to restrict businesses and the government can't protect all consumers.  Discussions followed regarding placing restrictions in the zoning code. 
Trustee Grabowski motioned, seconded by Trustee Krasovich to table Ordinance No. 2022-09, Prohibiting the Sale of Cats, Dogs, and Rabbits until revisions are made and brought back to the Village Board at a future date.
Motion carried 6-1; Trustee Belt voted nay.

7. Old Business

a. Discussion Regarding Strategic Plan Implementation Progress
None presented at this meeting

b. Discussion and Possible Action Regarding Parking in the Downtown Area Along the Lakefront and Safety Concerns
Trustee Belt stated several businesses were contacted.  It is too late in the summer to put a comprehensive plan together and suggested to table this item for a plan in 2023.  Trustee Grabowski stated that speed humps and signage have been purchased.  Discussion followed regarding how to proceed.
Trustee Krasovich motioned, seconded by Trustee Belt to form a committee to address the downtown parking safety to involve residents, business owners, Police, Plan Commission, and Trustees who will report back to the Village Board with recommendations in January 2023.
Motion carried 7-0.

8. New Business

a. Presentation, Discussion and Possible Acceptance Regarding Water System Master Plan Draft Report
This item was postponed to a future meeting.

b. Discussion and Possible Action on Rescheduling August 2, 2022 Village Board Meeting Due to National Night Out Event
Trustee Hill moved, seconded by Trustee Grabowski to approve rescheduling the August 2, 2022 meeting to meet on August 3, 2022, at 7:00 p.m.
Motion carried 7-0.

c. Discussion and Review of Draft Equipment Replacement and Capital Improvement Plan
Administrator Gosse presented the capital improvement plan and stated that it was presented to the Public Works & Safety committee on July 19, 2022, where it was recommended to the Village Board for adoption.  Updates will be made to the plan for the mill, pave and patching on Prospect as well as adding inflation increases to construction projects.  Gosse added that the Facilities Services Group has completed its assessment and the estimates will be added to this document.  Deputy Chief Mark Garry explained the technology items for the Police Department.   

d. Discussion and Possible Action on Committee Appointments

1. Plan Commission – 3 Members (full 3 year terms)
No action was taken.

2. Zoning Board of Appeals – 1 Member (full 3 year terms); 1 Alternate (term to expire 4/30/24)
No action was taken.

3. Historic Preservation Commission – 1 Plan Commission Member and 1 Member Architect (full 3 year term to expire 4/30/24)
No action was taken.

e. License Approvals and Vendor Permits

1. Premise Amendment
Trustee Hill moved, seconded by Trustee Rohde to approve the Premise Amendment as presented for Aladdin Campus Dining at Waukesha County Technical College located at 800 Main Street as presented.
Motion carried 7-0.

2. Temporary Retailer License
Trustee Rohde moved, seconded by Trustee Krasovich to approve the Class "B" temporary alcohol license to Positively Pewaukee for their Pints in the Park event to be held on August 25, 2022, at Kiwanis Village Park, 323 Capitol Drive as presented.
Motion carried 7-0.

f. Monthly Approval of Checks and Invoices for all funds – June 2022
Trustee Rohde moved, seconded by Trustee Belt to approve the June 2022 Checks and Invoices as presented. 
Motion carried 7-0.

Trustee Hill moved, seconded by Trustee Krasovich to recognize the Library Fund June 2022 checks and invoices as presented.
Motion carried 7-0.

9. Citizen Comments - 

Sarah Stephens @ 161 W Wisconsin Ave - Ms. Stephens requested for the Village Board to speak to tenants and other businesses that do not have a parking lot.

Cade Gerlach @ 1034 Oak Cir - Mr. Gerlach spoke regarding the downtown area and expressed that he believes that the Village bans other businesses and asking to adopt Ordinance 2022-10 is less intrusive than some of the other 

Jerry Sem a Future Resident at The Glen - Mr. Sem stated that Lake Geneva has people j-walking all over, he stated that fences don't work. 

Zack Stephens @ 161 W Wisconsin Ave - Mr. Stephens asked why is there a concern for safety on the street but not on the beach.

Nicholas Jenick @ 333 Park Hill Drive - Mr. Jenick thanked the Village Board for taking the time to form a committee and look into the downtown area.

Rachel Goedheer @ 309 Park Ave - Ms. Goedheer spoke in support of Ordinance 2022-10 regarding prohibiting the sale of cats, dogs, and rabbits.

Mark Grabowski @ 244 Park Ave - Mr. Grabowski stated that not one resident spoke in opposition of Ordinance 2022-10, regarding prohibiting the sale of cats, dogs, and rabbits.  

Megan Nicholson @ 806 W Shore Drive - Ms. Nicholson thanked the Village Board for their time listening to the residents.  She is happy to work with the Village Board on the proposed ordinance. 

Brian Belt @ 377 Park Ave - Mr. Belt stated that the proposed ordinance was tabled and not rejected.  He favors the idea of looking at ordinance 2022-10 as a zoning issue at the Plan Commission.  

10. Closed SessionThe Village Board of the Village of Pewaukee will enter into closed session pursuant to Wis. Statute Section 19.85(1)(e) for the purpose of deliberating or negotiating the purchasing of public properties, the investing of public funds, or conducting other specified public business, whenever competitive or bargaining reasons require a closed session, specifically regarding Riverside Preserve Developers Agreement, and pursuant to Wis. Statute Section 19.85(1)(g) for the purpose of conferring with legal counsel for the governmental body who is rendering oral or written advice concerning strategy to be adopted by the body with respect to litigation in which it is or is likely to become involved, specifically regarding 460 Park Avenue; Anna Heise Trust; and Wisconsin Department of Natural Resources.
Trustee Krasovich moved, seconded by Trustee Grabowski to move into Closed Session at approximately 10:01 p.m.
Motion carried on roll call vote 7-0.

11. Reconvene into Open Session

Trustee Hill moved, seconded by Trustee Rohde to reconvene into Open Session at approximately 10:35 p.m.
Motion carried on roll call vote 7-0.

12. Adjournment

Trustee Krasovich moved, seconded by Trustee Belt to adjourn the July 19, 2022, Regular Village Board meeting at approximately 10:36 p.m.
